SECTION 21 - MOBILE MESSAGE MARKETING PROGRAM

Greyno Co Apparel (hereinafter, “We,” “Us,” “Our”) offers a mobile messaging program (the “Program”), which you agree to participate in, subject to these Mobile Messaging Terms and Conditions and Privacy Policy (the “Agreement”). By opting in to or participating in any of our Programs, you accept and agree to these terms and conditions, including, but not limited to, your agreement to resolve any disputes with us through binding, individual-only arbitration, as outlined in the “Dispute Resolution” section below. This Agreement is specific to the Program and does not alter other Terms and Conditions or Privacy Policies governing your relationship with us in other areas.

  1. 1. User Opt-In
    By opting into our SMS/MMS messaging program, whether through an online or application-based sign-up form, you consent to receive mobile messages sent via automated systems or prerecorded content at the phone number you provided. You acknowledge that participating in this program is voluntary, and your consent is not required to make any purchases from Greyno Co Apparel. While you agree to receive marketing messages through automated systems, it is not guaranteed that all messages from us are sent using such systems. Standard message and data rates may apply, and the frequency of messages may vary.

    2. User Opt-Out

We are not responsible for any delays in receiving messages, as delivery depends on your service provider and is outside our control.

    8. Participant Requirements
    You must have a wireless device capable of two-way messaging, be subscribed to a participating carrier, and have text messaging service available. Some carriers may not support the service.

    9. Age Requirements
    If you are under 13 years of age, you may not use or engage with our program. If you are between 13 and 18 years of age, you must have your parent or legal guardian's consent to use the program. By using the program, you confirm that you meet these age requirements and have the necessary permissions to participate.

    10. Prohibited Content
    You agree not to send or share any harmful content through the program, including:

    • Fraudulent, defamatory, threatening, or harassing material
    • Offensive content, including hate speech, profanity, and discrimination
    • Malware, viruses, or harmful software

    11. Dispute Resolution
    Any disputes related to this agreement or the program will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association (AAA). The arbitration will take place in Vancouver, British Columbia, and the decision will be final and binding. Both parties waive the right to a jury trial and agree that claims will be resolved individually, not as part of a class action.

    12. Florida Law Compliance
    If you are a Florida resident, we assume you are a resident if your shipping address or phone area code is from Florida. You agree that any responses to your messages from us are not subject to Florida’s telemarketing regulations, as long as they are in response to your inquiries or requests.

    13. Miscellaneous
    By participating, you confirm you have the right to enter into this agreement. Failure to exercise any rights under this agreement will not waive those rights. If any part of this agreement is found unenforceable, it will be limited to the minimum necessary to keep the rest of the agreement in effect.
